T.L.O

  1. The fourth amendment clearly states that the search or seizure of a person's property without a proper warrant is is illegal. The Principal had no authorized search warrant to search T.L.O's purse nor its contents.
  2. Schools have rules individual of those of the law. In school you must abide by the selected rules. When school officials saw that T.L.O and her friend may have been breaking those rules they had the right to further investigate.
  3. I think that T.L.O and her friends fourth amendment rights should apply. If the teacher had clearly already seen both girls in the bathroom smoking what would be the need to search T.L.O's purse for other evidence. At that point the girls should have gotten the consequences for smoking in the bathroom at their school. The only reasonable circumstance for searching the girls purse would be if the was a danger to themselves or other students evident when seen in the bathroom.
  4. I believe that my school would not search belongings unless a danger was clearly present; however, if rules were being broken there would be consequences.
  5. I think the Supreme Court should rule that the Assistant Principal are in violation of T.L.O and her friend's fourth amendment rights.
